As battle against production and usage of thin plastic continues Qingdao Recycling Limited has obtained a fresh court order stopping Malawi Environmental Protection Authority (MEPA) from enforcement of another court order allowing MEPA to implement a ban on usage of thin plastics.
A Lawyer representing Qingdao Recycling Limited John Chisomo Kalampa said that government can not enforce ban on production and usage of thin plastics in Malawi without establishment of Environmental Tribunal.
They also argued that the ban on thin plastics is violation of economic rights for companies that produce and sell thin plastics.
Attorney General Frank Mbeta insisted that despite unavailability of the Environmental Tribunal this cannot stop MEPA from enforcement of ban on thin plastics as High Court Judge Allan Muhome granted a stay on the enforcement of the ban while judicial review continues on the matter.
