BREAKING: Cabinet Ministers Reportedly Summon RBM Governor, Pressure Him to Drop Amaryllis Hotel Case

Questions emerge over RBM’s independence as alleged pressure mounts ahead of court proceedings

It is alleged that cabinet ministers Roza Mbilizi, Joseph Mwanamvekha and Peter Mukhitho, together with the Attorney General, summoned the Governor of the Reserve Bank of Malawi (RBM) and instructed him to discontinue the Amaryllis Hotel case.

The meeting was reportedly chaired by RBM Deputy Governor Henry Mathanga.

The allegations raise questions about the independence of the central bank and whether it is facing political pressure over a case it is spearheading.

The case, reportedly scheduled for September 29, is being pursued by the Reserve Bank of Malawi rather than the Office of the Attorney General.

There is also a potential conflict-of-interest question surrounding the transaction. The current Attorney General is alleged to have signed off on the deal, while the current Minister of Finance is said to have approved and authorised payment for it.

The key question now is whether the RBM will maintain its position or discontinue the case amid the alleged pressure.

While the Attorney General has constitutional and statutory responsibilities concerning the institution and discontinuation of criminal proceedings, the precise legal powers applicable to this case require careful examination.

Section 5 of the Reserve Bank of Malawi Act should also be considered in determining the extent of the bank’s autonomy and the limits of external influence.

As the nation awaits further developments, attention is turning to how the case will proceed and whether the allegations of political interference will be addressed.

Meanwhile, anticipation is building over the release of a second video clip, which could add another dimension to the unfolding controversy.

For now, the central issue remains whether the proceedings will continue as planned and how the relevant institutions will respond to questions about accountability, institutional independence and the rule of law.
