I am shaking my head after being alerted that The Supreme Court Judge has ruled that the Reserve Bank of Malawi should compensate the Finance Bank for illegal revocation of its licence back in 2005. What is more interesting is the fact that our learned Judges went ahead directing that compensation calculation should be computed from 2005 to date! What the hell is this shit?? A bank that was voluntarily liquidated in 2005.
Who are the lawyers?
Lawyers representing the bank are the same who represented Chakwera and Chilima in the constitutional election case. Wapona Kita, Mordecai Msika and others.
Who are the judges??
The judges who presided over this case are the same who sat on the panel of the constitutional Court and nullified APM’s 2019 electoral victory. Immediately after Chakwera won the fresh elections, he promoted Justice Healey Potani, Justice Ivy Kamanga, both promoted in 2020. In the year 2022, Chakwera also promoted Justice Dingiswayo Madise and four others. In short, between 2020 and 2025 , Chakwera appointed 9 Judges to sit on the SUPREME Court bench.
Fear of unknown or bitterness?
I can conclude that these Judges are not comfortable with the return of Peter Mutharika who they embarrassed through a cooked judgement in 2020. They are afraid that Professor Arthur Peter Mutharika might avenge the stupid thing they did so they have resorted to strike first with the hope of bringing chaos!
Whose interest are they serving??
The judges are no longer serving the interests of Malawians! They are serving their own interests and those of Chakwera.
What would be the way forward??
All judges who do not serve the interaction of Malawians must be impeached! They are paid by Malawians and the Judiciary is part of the Government not a parallel arm or opposition entity!
A law must be immediately drafted and passed giving powers to The President to move parliament at any given moment to impeach judges who are hell bent on raping the plight of Malawians
